Default grinding noise in transfer case

My wifes 08 escape is at the dealer for what should be covered under warranty. there is 56,789 miles on escape,there is a grinding noise coming from the transfer case. service manager told my wife warranty is under review because they think tire wear(uneven) and lack of rotation my void warranty. i have rotated the tires on a regular basis myself. they said how do know that they were rotated. i recently replaced 2 tires because they were about wore out. dealer asked if i had old tires so they could see them. who keeps old tires. they are insisting that the tires caused the problem, if that is the case the drivetrain is crap.

If a vehicle has full time 4 wheel drive is is possible for different size tires to cause problems in the drivetrain system. Most of the time it causes problems with the ABS system because the wheel speed sensors provide different readings and the system thinks different wheels are locking up.

service manager measured the circumferance of the tires and said there is a 3/8" difference in tire circumference and the is what caused the damaged. i told her save her B.S. for someone who will believe it i know better. i have a friend who owns a trans. shop,2 other friends who used to rebuild trans., all have said tires did not cause the problem,tires will make it sound worse.

we will see how it turns out.
